PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE AUTO TRADING SOFTWARE OFFERED BY WWW.ALGOFX.LTD. BY USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT USE THE SOFTWARE.

LICENSE

WWW.ALGOFX.LTD hereby grants you a limited, non-exclusive, non-transferable license to use the Auto Trading Software offered by WWW.ALGOFX.LTD solely for your personal use. You may not sublicense, distribute, or transfer the Software or any copy thereof to any third party. You may not modify, adapt, translate, reverse engineer, decompile or disassemble the Software.

USE OF SOFTWARE

You acknowledge that the use of the Auto Trading Software may involve risk, including the risk of loss of funds, and that you assume full responsibility for such risk. WWW.ALGOFX.LTD does not provide investment advice, and the Software is provided for informational and educational purposes only. You should seek independent advice from a financial advisor before using the Software or engaging in any trading activities.

INTELLECTUAL PROPERTY

The Auto Trading Software and all intellectual property rights in the Software are owned by WWW.ALGOFX.LTD. You may not copy, reproduce, distribute or create derivative works based on the Software without the prior written consent of WWW.ALGOFX.LTD.

WARRANTIES AND DISCLAIMER

WWW.ALGOFX.LTD makes no representations or warranties of any kind, express or implied, with respect to the Auto Trading Software, including but not limited to, warranties of merchantability or fitness for a particular purpose. WWW.ALGOFX.LTD does not guarantee the accuracy or completeness of any information provided by the Software, and shall not be liable for any loss or damage resulting from the use of the Software. You acknowledge that the Software may be subject to interruption, transmission delays, errors or omissions, and that WWW.ALGOFX.LTD shall not be liable for any such interruptions, delays, errors or omissions.

LIMITATION OF LIABILITY

In no event shall WWW.ALGOFX.LTD be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or in connection with the use or inability to use the Auto Trading Software.

INDEMNIFICATION

You agree to indemnify and hold WWW.ALGOFX.LTD, its officers, directors, employees, agents, and affiliates, harmless from any claim, demand, action, damage, loss, cost or expense, including without limitation reasonable attorneys’ fees, arising out of or in connection with your use of the Auto Trading Software.

TERMINATION

This Agreement shall remain in effect until terminated by either party. WWW.ALGOFX.LTD may terminate this Agreement immediately without notice if you breach any provision of this Agreement. Upon termination, you shall immediately cease all use of the Auto Trading Software.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and WWW.ALGOFX.LTD with respect to the Auto Trading Software, and supersedes all prior or contemporaneous agreements, representations or understandings, whether written or oral.

AMENDMENTS

WWW.ALGOFX.LTD reserves the right to modify this Agreement at any time without notice. Your continued use of the Auto Trading Software after any such modifications shall constitute your acceptance of the modified Agreement.

SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ASSIGNMENT

You may not assign or transfer this Agreement or any of your rights or obligations hereunder, without the prior written consent of WWW.ALGOFX.LTD. WWW.ALGOFX.LTD may assign this Agreement or any of its rights or obligations hereunder without your consent.

WAIVER

The failure of either party to enforce any provision of this Agreement shall not be deemed a waiver of such provision or of the right to enforce such provision.

By using the Auto Trading Software offered by WWW.ALGOFX.LTD, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
